Why can't out-of-line politicians be excommunicated?

To the Catholic Sentinel:
I have been reading church history. In the past when rulers publicly went against church teaching they were publicly excommunicated.
Why can’t our modern day bishops publicly excommunicate members of Congress and the Supreme Court who vote or uphold positions or laws that are against natural moral law or church teaching?
