Attorney general silencing Oregonians, says Oregon Catholic Conference

After a decision by U.S. District Judge Michael McShane to reject an attempt to intervene in a lawsuit seeking to repeal Oregon's constitutional marriage amendment, defining marriage as between a man and a woman, Attorney General Ellen Rosenblum has effectively silenced the Oregonians who voted for the amendment, said the Oregon Catholic Conference in an official statement.

The National Organization for Marriage filed an attempt to intervene in the case on behalf of its Oregon members after Rosenblum earlier this year declined to defend the state law. The judge denied the motion, stating the organization was unreasonably late in its request and could not simply seek in intervene in the place of the attorney general to defend the law.

"Oregon's constitutional marriage amendment was carefully considered and thoroughly debated prior to its overwhelming passage in 2004. It represents the express will of the people of Oregon and is the duly enacted law of the state.  In refusing to defend the law, and contrary to her oath of office, the Attorney General has unilaterally disregarded this decision of the people and has effectively silenced the voices of all the citizens of Oregon who voted to preserve marriage in the constitution as the union of one man and one woman," said the statement from the Oregon Catholic Conference.
"The Oregon Catholic Conference had hoped that marriage between one man and one woman, as voted into the constitution by the people of Oregon, would not be overturned in a courtroom without a single voice speaking in favor of it.  Oregonians recognize the uniqueness of marriage between one man and one woman.  Marriage provides every child with a mother and father and seeks to foster the optimal, loving and supportive environment for raising children.  Loving and stable marriage between a man and a woman provides the best foundation for a strong, healthy, and just society.  It is worthy of a voice in the courtroom.  Sadly, now, it seems that marriage as God designed it and the people of Oregon recognize it, will not receive a fair hearing in the federal court."

Officials of the National Organization for Marriage said they will appeal the judge's order to the 9th U.S. Circuit Court of Appeals and attempt to win a stay halting Judge McShane from taking further action.

Of course Rosenblum's refusal was both insulting and ignorant. I have posted a Letter on oregonlive this morning entitled "Many words cannot make it plainer" comparing her and McShane's acts with the wise moves taken in a similar situation in 1908.
